Photogaraphy NorthWest Standard photographic Terms

These terms apply to

BOOKING FEE – A deposit of 10% is normally charged when The Client signs the contract and will secure your wedding photography booking when paid.

ADDITIONAL CHARGES – Please note that PayPal charges a 3.5% fee which has to be passed to the customer (although if you select the “Friends / Family” option you will not be charged and so there is no fee).  Payment Online using a Debit and Credit Card will incur a 2.5% additional charge.  There is no charge for payment by Cheque / Cash.

PRICING – Your quoted price normally includes all expenses incurred by The Photographer (eg. travel).  Signing this contract will fix the price of the minimum order but where the booking is 6 months or more in advance The Photographer reserves the right to increase prices reasonably to cover increased costs, etc.  An invoice from The Photographer is supplied upon request.  Prices are subject to change without notice.

FULL PAYMENT – Although I don’t require full payment before the wedding, payment in full is required before your Photographs are delivered to you.  Failure to pay may result in the cancellation of The Contract and may forfeit your Photographs.

PHOTOGRAPHS – The Photographer will endeavour to provide The Client with Final Versions of the pictures taken – this includes enhancement, digital retouching, and any other finishing carried out or deemed necessary by The Photographer.  The Photographer supplies images he deems to be appropriate.  Digital negatives (Raw Files) are not supplied to The Customer.

RE-ORDERS – All re-orders shall be treated as an extension of this contract and further copies of Final Versions of the Photographs are available at a fair charge. No responsibility for error will be accepted unless orders are given in writing.

COPYRIGHT AND OWNERSHIP – The 1988 Copyright Act assigns copyright to The Photographer.  Any Previews and Proofs remain the property of The Photographer unless otherwise specifically contracted in writing.  All Digital Files and Media remain the property of The Photographer.

THE CLIENT LICENCE – Permission is given in this contract by The Photographer to The Client allowing them to print, email, upload to social networking sites, etc. any supplied pictures.  The Client must credit The Photographer in all cases and must not modify the Photographs in any way.

PHOTOGRAPHERS LICENCE – The Photographer shall be granted artistic licence in relation to the poses photographed and the locations used. The Photographers’ judgement regarding locations, poses and number of Photographs taken shall be deemed correct. No picture can be guaranteed although the Photographer will always try to give The Client everything they want within reasonable grounds.

FURTHER USAGE – The Photographer’s copyright applies to all images and all supplied materials.  The Photographer shall use any images for self-promotion or advertising including publishing in local press, wedding publications, etc.

MODIFICATIONS – The Client or any other party are strictly forbidden to alter or duplicate the Photographs in any way without written permission from The Photographer.

PHOTO ALBUMS & MEDIA – In the event that any loaned Album or other Photographs or property is lost or damaged before it is returned to The Photographer, or its non-return within 1 month, The Photographer may invoice the full value, at current prices, of the album and all missing or damaged Photographs or equipment. Proof of posting does not constitute proof of return.

CANCELLATIONS – Cancellations from The Client in writing are required. In the event that The Client cancels the contract the booking fee shall be forfeited. In addition, if notice of cancellation be received by The Photographer 6 calendar months or less prior to the appointment, The Client shall pay The Photographer a sum equal to 60% of the remaining balance. The said sum shall be payable as compensation being an agreed estimate of the financial loss The Photographer would suffer.  The due performance of this contract is subject to alteration and/or cancellation by The Photographer.  In the event of total photographic failure or cancellation of this contract, The Photographers liability shall be restricted to the refund of all monies paid.

WILLINGNESS OF SUBJECTS & INTERFERENCE – The Photographer shall not be responsible for the performance of Photographs being affected by persons whom are unwilling to have their photograph taken. Family, friends, other guests and other service providers of the Client shall be permitted to photograph the wedding as long as they do not interfere with the Photographers’ duties as this may result in official shots being missed.
